What is Arbitration?

Arbitration is a principal method of alternate dispute resolution. This method is often preferred by those who are party to a large value, complicated contracts, and international commercial agreements to avoid the time-consuming and costly process of going to court. Arbitration is a formal procedure that aims to result in a final decision being made that is binding on all parties.

Arbitration is a contractual procedure, a decision made through this process becomes enforceable in courts if breached.

The procedure of Arbitration consists of appointing a Barrister, Solicitor or another professional to conduct a timetable for resolution. Written submissions are often made by both the claimant and defendant involved detailing their side of the matter. This is then considered by the arbitrator to make a legally binding decision known as an ‘award’.
